1. Acceptance of Terms

By accessing lumient.la or purchasing our products, you (“Customer” or “you”) agree to be bound by these Terms & Conditions (“Terms”) and any additional policies referenced herein, including our Privacy Policy. If you do not agree, do not use the Site or Services.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Services. By placing an order, you represent and warrant that you meet these requirements.

3. Products & Orders

• All products are described and priced in U.S. dollars. We reserve the right to limit quantities or discontinue items at any time.
• An order is an offer to buy. Acceptance occurs when we dispatch the goods and send you a shipping confirmation.
• We strive for accuracy but occasional errors in pricing or product information may occur. If we discover an error, we will contact you for instructions or cancel the order and issue a refund.

4. Payment

We accept major credit/debit cards and other payment methods displayed at checkout. By submitting payment information, you represent that you are authorized to use the chosen method and authorize us (or our processor) to charge the full amount, including shipping, taxes, and any applicable fees.

5. Shipping & Risk of Loss

Title and risk of loss pass to you upon our delivery of the goods to the carrier. Delivery dates are estimates and not guaranteed. We are not liable for delays beyond our control.

6. Returns & Refunds

You may return unused, undamaged stock candles or parts within 30 days of delivery for a refund or exchange, subject to our Return Policy. Custom or private-label orders are final-sale unless defective.

7. Intellectual Property

All content on the Site—including text, graphics, logos, images, and code—is owned by or licensed to Lumient and protected under intellectual-property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

8. User Content

If you post reviews, comments, or other content, you grant Lumient a worldwide, royalty-free, perpetual, irrevocable right to use, reproduce, modify, publish, translate, distribute, and display such content in any media. You represent that you have the necessary rights to grant this license and that your content is not unlawful, defamatory, or infringing.

9. Prohibited Conduct

You agree not to: (a) use the Site for any unlawful purpose; (b) interfere with or disrupt any servers or networks; (c) attempt to gain unauthorized access to other accounts; (d) use automated means to access the Site without permission; or (e) bypass measures we use to restrict access.

10. Disclaimer of Warranties

SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE ABOVE MAY NOT APPLY TO YOU.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMIENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE SERVICES; (B) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR CONTENT OR DATA; OR (C) ANY OTHER MATTER RELATING TO THE SERVICES.

12. Indemnification

You agree to defend, indemnify, and hold harmless Lumient, its officers, directors, employees, and agents from and against all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorneys' fees) arising from your use of the Services or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Site at any time for any reason without notice. Sections intended to survive termination (including but not limited to ownership, disclaimers, limitations of liability, and indemnity) shall continue in effect.

14. Governing Law & Dispute Resolution

These Terms and any dispute shall be governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Los Angeles County, California, except that either party may elect binding, confidential arbitration under the rules of the American Arbitration Association.

15. Changes to Terms

We may modify these Terms at any time. Updated versions will be posted here with a revised Effective Date. Your continued use of the Services after changes constitutes acceptance of the revised Terms.
